The Roxbury Arts Group (RAG) announces an Open Call for Artists to submit work for an Installation Exhibit. Artists have the opportunity to transform the Walt Meade Gallery, a space normally reserved for traditional gallery exhibitions.

The Roxbury Arts Group (RAG) announces an Open Call for Artists to submit work for an Installation Exhibit. Artists have the opportunity to transform the Walt Meade Gallery, a space normally reserved for traditional gallery exhibitions. The installation will run January 23 – March 5, 2016, with an Opening Reception Saturday, January 23 from 4 – 6 pm.  RAG has purposely left this call unrestrained so artists have the freedom to create in any medium and on any subject matter. The artist chosen for the installation will host an artist talk on a subject to be determined by them.  Submissions are due to the Roxbury Arts Group by Friday, December 4, 2015.  Call 607.326.7908 or visit the artLINX page at www.roxburyartsgroup.org for information on how to submit.

“The Walt Meade Gallery is small enough to feel intimate yet large enough to allow an artist to create an immersive atmosphere,” says Annie Schwed, Grants and Community Coordinator at the Roxbury Arts Group.

Artists can submit up to three pieces for consideration by the Roxbury Arts Group exhibit panel. Submissions should include a complete description of the installation with an artist statement; three images of previous work; dimensions; materials; and a description of the accompanying artist talk.  For more detailed information on what to submit for consideration visit www.roxburyartsgroup.org or call 607.326.7908. All are invited and welcomed to celebrate the season, and working together as a business community. At several recent business mixers the association has met with lots of interest and renewed enthusiasm for fostering and building business in Roxbury. In addition, the GRBA has recently formed a new Advisory Council composed of a group of people that have positive energy and ideas for helping grow the business community of Roxbury. The association is looking forward to an exciting year ahead with plans for the completion of a new website (both visitor and business tailored) with an enhanced digital strategy, as well as strengthening collaboration with business groups in our region to grow our community, in addition to many other ideas.

To kick off the holidays and renewed efforts to mingle, network and exchange, the organization is offering a complimentary holiday party on December 8, at The Public Lounge for any business, organization or community member who is interested in becoming a part of the organization for a $40 annual membership. To list a second or a third business the cost is $25. The annual fee for non-profit organizations is $15. If you wish to bring guests, they are welcomed; the cost is $15 per person. If you do not wish to commit to membership at this time, but want to attend the party to find out more, or if you don’t have a business, but wish to attend the cost is $15 per person. Hors d’oeuvres will be served, and a cash bar with discounted wine and beer will be available. Membership forms are attached. Please, bring them with you to the party. RSVP by November 30.

Roxbury Town Board Approved Meeting Minutes - November 5, 2015

A Public Hearing and regular meeting of the Town Board were held November 5, 2015 at 7:00 pm at the Town Hall. Present were: Supervisor Thomas S. Hynes, Councilmen Gene Cronk, Edward Raeder, Allen Hinkley and Carol Murray, Highway Supt. Stephen Schuman, Attorney Kevin Young and 11 residents.

APPROVED MINUTES

November 5, 2015

A Public Hearing and regular meeting of the Town Board were held November 5, 2015 at 7:00 pm at the Town Hall.  Present were:  Supervisor Thomas S. Hynes, Councilmen Gene Cronk, Edward Raeder, Allen Hinkley and Carol Murray, Highway Supt. Stephen Schuman, Attorney Kevin Young and 11 residents.

The Public Hearing was called to order at 7:00 pm.  The notice was read calling for the hearing on the 2016 Preliminary Town Budget.  Budget Officer Carolynn Faraci stated the Preliminary Budget contains approved changes from the Budget Workshop and discussed the changes needed to make to the budget since the budget workshop to include: General Fund Appropriations A1450.4- Elections to account for a third primary, increase line to $11,165;  General Fund Revenues 2770 –Election Reimbursement, increase line to $10,635;  Roxbury Sewer Appropriations add line SS 9950.0 Transfer to Capital Fund $4,390.69 per the 2016 sewer rate chart.

Evelyn Irwin questioned the proposed raises in salary for the Highway Supt. and Tax Collector who are new to the positions this year, issues with highway employees receiving the same rate of pay for different years of service and questioning why a new truck is needed.  It was stated the raises for the Highway Supt. and Tax Collector would be discussed later in the meeting, the highway workers themselves agreed to only a two year reduced salary plan for new hires and the new truck is needed to replace either the 2001 Ford or 2003 Chevy truck in use now.

Councilwoman Carol Murray questioned the added revenue line for the inter-fund transfer from Good Neighbor Fund.  The Budget Officer stated the Board had discussed using Good Neighbor funds for purchasing a new Constable vehicle if needed so the line was added to offset the appropriation line for the vehicle.

With no other comments being heard, the hearing closed at 7:20 pm.

The regular meeting was called to order at 7:21 pm.

The Town Board welcomed Roxbury Central School Government class students Zachary Caronia, Beau O’Donnell, Tyler Phillips, Taylor Peters, Jennifer Blunt, Kelly Hanrahan, Marisa Ford and Sarah Schuman.  Supv. Hynes discussed Town Board responsibilities and other positions within the Town structure.

Zachary Caronia further questioned the highway salary issued raised by Mrs. Irwin.  Attorney Kevin Young explained the highway workers are a union and negotiate their contract with the Town Board.

Rob Allison of Catskill Region Surveying Services and Rick Woidt of Woidt Engineering discussed the GEIS Flood Study of the Grand Gorge area that is being funded by Catskill Watershed Corp. (CWC).  The study would be conducted to determine flood elevations that could benefit some properties that are being shown as being within the new proposed flood zones.  This in turn would take them out of the flood area helping owners avoid the cost of flood insurance for themselves and future buyers.  Public meetings would be held to obtain information from owners on water issues, etc.  The project cost is estimated at $55,000 and would take 2-3 months to complete.

RESOLUTION #84-CONTRACT FOR GEIS PROJECT GRAND GORGE

On motion of Gene Cronk second by Allen Hinkley the following resolution was offered and adopted:

“WHEREAS, the Town Board of the Town of Roxbury has determined the need for preparation of a Generic Environmental Impact Statement for the hamlet of Grand Gorge for the purpose of conducting a detailed hydraulic study and remapping of the floodplain of the Bear Kill; and

WHEREAS, the Town Board of the Town of Roxbury finds that it is in the best interest of the Town to retain an independent consultant to prepare the technical documents required for the proposed study; and

WHEREAS, the Town Board of the Town of Roxbury and the Town Attorney have reviewed the Proposal entitled “Proposal for Grand Gorge Flood Analysis” prepared by Woidt Engineering; and

WHEREAS, the Town Board has determined the adequacy of the proposal submitted by Woidt Engineering; and

WHEREAS, the Town Board desires, at this time, to enter into the GEIS Consulting Agreement with Woidt Engineering.

NOW THEREFORE, BE IT RESOLVED AS FOLLOWS BY THE TOWN BOARD OF ROXBURY, DELAWARE COUNTY, NEW YORK:

The Town Board of the Town of Roxbury hereby authorizes the Town Supervisor to execute the GEIS Consulting Agreement between the Town of Roxbury and Woidt Engineering for the Grand Gorge flood analysis as outlined in the November 5, 2015 Proposal submitted to the Town Board.”

Highway Supt. Stephen Schuman reported crews have been hauling sand, trucks are ready for winter, CHIP monies have been applied for with payment expected in December, requested a resolution for Golf Course Rd. that has just been determined to not be on the NYSDOT road list for CHIP money and the sidewalk at the corner of Becker Ave. and State Hwy. 30 Grand Gorge has been filled in underneath for more support.

RESOLUTION #85- ADD GOLF COURSE RD. TO NYSDOT TOWN ROAD LIST

On motion of Gene Cronk second by Allen Hinkley the following resolution was offered and adopted:

“WHEREAS, the Town of Roxbury’s Town Highway Department holds title to and has been maintaining a .32 mile portion of Golf Course Road from Burrough’s Memorial Road to the cul-de-sac at the end of Golf Course Road for the past 16 years; and

WHEREAS, the Highway Department has requested that the Town Board take the necessary steps to formally add this .32 mile portion of Golf Course Road to the Town’s Inventory of Public Roads in order to continue to legally maintain such portion; and

WHEREAS, the Town Board and the Town Attorney have reviewed and discussed the Highway Department’s request; and

WHEREAS, the Town Board believes that it is in the best interest of the Town to add the subject portion of Golf Course Road to the Town’s Inventory of Public Roads.

NOW THEREFORE, BE IT RESOLVED AS FOLLOWS BY THE TOWN BOARD OF ROXBURY, DELAWARE COUNTY, NEW YORK:

The Town Board of the Town of Roxbury hereby amends the Town’s Inventory of Public Roads to include the .32 mile portion of Golf Course Road beginning at Burrough’s Memorial Road to the cul-de-sac at the end of Golf Course Road.”

Evelyn Irwin questioned the need to upgrade the generator at the highway garage.  It was stated the upgrade is necessary because the current generator is only large enough to run the radio antennae whereas the larger generator will run the entire highway building in case of an outage.

Highway Supt. Schuman will be retiring on November 15th and was commended on his 28 years of service with the Town.

RESOLUTION #86 – RESOLUTION TO GO INTO EXECUTIVE SESSION TO DISCUSS PERSONNEL AND POTENTIAL LITIGATION ISSUES

On motion of Allen Hinkley second by Carol Murray the following resolution was offered and adopted:

“RESOLVED, the Town Board agreed to enter into Executive Session at 8:15 pm to discuss personnel issues involving 2016 budget salaries and potential litigation issues. Present were: Supervisor Thomas S. Hynes, Councilmen Allen Hinkley, Edward Raeder, Gene Cronk and Carol Murray, and Attorney Kevin Young.”

It was stated the decisions of the Town Board from Executive Session are as follows: non-highway employees/elected officials will receive a 2% raise for 2016 except that Highway Supt., Tax Collector, Supervisor and Councilmen will remain at the 2015 salaries; and no action was taken on the potential litigation issue.

No action was taken on the Police Policy.

On motion of Carol Murray second by Edward Raeder the Town Board approved the Town Clerk’s monthly report for October 2015 in the amount of $1,928.49 (Town Clerk $903.49 and Building Permits $1,025.00)

RESOLUTION #87 – UNPAID WATER AMOUNTS TO TAXES

On motion of Carol Murray second by Gene Cronk the following resolution was offered and adopted:

“WHEREAS, Notices of Unpaid Water amounts were mailed to customers in their October 1, 2015 water bills; and

WHEREAS, said Notice stated the balance due on the bill must be received by November 1, 2015 or be placed on the January 2016 Town/County tax bill;

NOW, THEREFORE BE IT RESOLVED, the Town Board authorizes the following amounts of unpaid water be sent to Delaware County to be placed on the January 2016 Town/County tax bills: Denver Water $1,757.58; Grand Gorge Water $5,993.97 and Roxbury Water $5,103.17.”

Discussion took place on the 2016 Preliminary Budget.  The Town Board approves the appropriate changes to the preliminary budget to account for the items discussed at the Public Hearing pertaining to General Fund and Roxbury Sewer District and the Town Board’s decision from Executive Session to change salaries for non-highway/elected personnel.  Discussion took place on the Constable vehicle that was kept in the preliminary budget.  Councilman Cronk stated he did not want a new Constable vehicle included in the 2016 budget but no other Board member agreed to remove it, and no other changes discussed during the Budget Workshop or Public Hearing were opposed.

RESOLUTION #88-ADOPT 2016 TOWN BUDGET

On motion of Edward Raeder second by Carol Murray the following resolution was offered and approved:

“WHEREAS, the Town Board has discussed and reviewed the 2016 Preliminary Budget; and

WHEREAS, the Town Board has approved appropriate changes as per discussed in the Budget Workshop, Public Hearing and as a result of Executive Session; and

WHEREAS, said changes shall be included in the adopted budget; and

WHEREAS, a majority of the Town Board have agreed to keep the price of a new Constable vehicle in the budget;

NOW, THEREFORE BE IT RESOLVED, the Town Board, Town of Roxbury adopts the 2016 Town Budget as amended with approved changes.

The Town Board discussed a list of needed repairs to the Constable car received from WS Hinkley & Son that included the transmission having shift problems, front and rear brakes will be needed very soon and oil pressure needs to be checked as it’s fluctuating on the gauge.  The Town Board will get estimates on costs.

It was stated the 2016 Denver Sewer and Roxbury Sewer budgets have been approved by NYC DEP.

No action was taken on revising the Grand Gorge and Roxbury Water District bylaws.

Kevin Young stated DEP has set aside $15M for land acquisition associated with flood mitigation. Delaware County asserts that the acquisition of improved property should only occur at the request of a local municipality and as part of an overall local flood mitigation plan ; Delaware County opposes a land acquisition program that would allow the City to purchase improved property in the flood plain based upon homeowner request and the town’s consent because the town may not be able to effectively control or limit such acquisitions.

Edward Irwin questioned why there is a boat at the Transfer Station and asked why the Town purchased a new brush cutter/mower this year and why the tires had to be replaced already on the same brush cutter/mower. Supv. Hynes stated the boat will be removed. Hwy. Supt. Schuman stated the old mower was too small for the mower head and the tires that came on the new mower were in the Federal bid specs that the Town purchased the machinery under and were of cheaper quality.

On motion of Carol Murray second by Edward Raeder the meeting adjourned at 8:48 pm.

The RLA quilt raffle drawing for the 2015 RLA “Blues” quilt, expertly handcrafted by the Roxbury Library Quilters, will take place at 1:30 p.m., directly following the 2015 RLA Annual Holiday Bazaar.

Located at 53742 State Highway 30, the Roxbury Library is directly opposite the town’s United Methodist Church on Main Street.

The Roxbury Library Association is pleased to announce that the RLA has received a fall 2015 Pilcrow Foundation Children’s Book Project Grant, in support of rural libraries’ children’s book acquisitions. The Pilcrow Foundation has awarded the RLA $800.00 for the purchase of children’s books, with the expectation that the RLA will raise $400.00 in matching funds towards expanding the Roxbury Library’s children’s book collection.

The Roxbury Library Association is now welcoming donations to the RLA in order to raise Pilcrow Grant matching funds. By raising $400.00 in matching funds, the RLA will be able to add a substantial number of children’s books from the Pilcrow Foundation to the Roxbury Library children’s collection, with a total of $1,200.00 in children’s book purchase funding.

Roxbury Town Board Special Meeting Approved Minutes - October 26, 2015

October 26, 2015

A Special meeting of the Town Board was held October 26, 2015 at 7:00 pm at the Town Hall.  Present were: Supervisor Thomas S. Hynes, Councilmen Gene Cronk, Edward Raeder, Allen Hinkley and Carol Murray, Budget Officer Carolynn Faraci, Highway Supt. Stephen Schuman and 2 residents.

The meeting was called to conduct a budget workshop on the 2016 Tentative Budget and to discuss any other business that may come before the Town Board.

The Budget Officer discussed her proposed changes to some budget lines based on current information just received.

Discussion took place on several line items, and especially on highway matters, replacing the Constable vehicle and salary increases for the new Tax Collector and Highway Supt. positions.  Councilman Cronk felt the Constable vehicle could go another year and wanted it taken out of the budget adding that if it did need to be replaced, Good Neighbor Funds could be used. When asked individually by the Supervisor if the vehicle was to stay in the budget, with the exception of Councilman Cronk, all Board members agreed it should remain in the budget at this time.

The following reflects the changes agreed upon by the Town Board for the Preliminary Budget:

General Fund

Appropriations:

3120.2  Constable – remove $15,000 for car computer
5132.2 Highway Garage – increase to $20,000 for additional funds for generator
7310.4 Youth Program – increase to $475 based on reimbursement paperwork submitted by school

Revenues:

3820 Youth Program – increase to $475 based on above
5031 Interfund Transfer – add line to include $32,000 to replace Constable vehicle if needed, funds to be transferred from Good Neighbor Funds.

Highway Fund

Appropriations:

5110.1 – the line will increase accordingly to include re-hiring Stephen Schuman part-time for 30 weeks at HEO pay rate for mowing and snowplowing as needed
5130.2 Equipment – decrease to $60,623 to account for one half of the new truck cost to be paid from the equipment reserve fund and for a decrease in the cost of a new sweeper
9030.8 Social Security – increase accordingly to include Schuman part-time

Roxbury Sewer

Revenues:

2770 NYCDEP Subsidy – increase to $161,275 per DEP approval letter

Other:

Unexpended Balance – decrease to 0 ($1,222.96 is in a Capital Reserve Fund)
Amount to raise by Tax (Town Share) – increase to $41,077.66

Grand Gorge Fire

Amount to Raise By Tax $150,875 (clerical error-transposed numbers)

RESOLUTION #83 – SCHEDULE PUBLIC HEARING 2016 PRELIMINARY BUDGET

On motion of Allen Hinkley second by Edward Raeder the following resolution was offered and adopted:

“WHEREAS, the Preliminary Budget for the year 2016 has been completed;
BE IT RESOLVED, the Town Board will hold a Public Hearing on the 2016 Preliminary Budget on November 5, 2015 at 7:00 pm at the Town Hall; and

BE IT FURTHER RESOLVED, pursuant to Section 108 of the Town Law, the proposed salaries of elected officials are as follows: Councilman (4) $4,714.68 each; Justice (2) $8,010.31 each; Supervisor $14,720.75; Tax Collector $9,627.32, Town Clerk $40,605.03 and Highway Supt. $53,810.78.”

A report was received from Attorney Kevin Young and given to the Town Board reporting his findings regarding the outdoor woodstove issues between the Serrie’s and Bonci’s.  Corrective action by Mr. Bonci includes raising the stack height, limit use to the heating season and installed a knock-out cap on the stack to reduce the solid particulate.  The Town Attorney will contact Mr. Bonci in 60 days to see if the corrective measures are working.

Highway Supt. discussed issues with Golf Course Rd. not being on the NYSDOT road list for Town roads and stated a resolution would be needed from the Town Board approving the road to be added to the road list.  The Town Board will do a resolution at the November meeting.  Schuman also stated CHIPS money is expected to be received in December.

A reminder was given that the regular meeting for November will be held Thursday November 5, 2015 at 7:30 pm or immediately following the Public Hearing, whichever is later.

On motion of Carol Murray second by Edward Raeder the meeting adjourned at 8:35 pm.

October 12, 2015

A Public Hearing and regular meeting of the Town Board were held October 12, 2015 at 7:15 pm at the Town Hall. Present were:  Supervisor Thomas S. Hynes, Councilmen Gene Cronk, Edward Raeder, Allen Hinkley and Carol Murray, Highway Supt. Stephen Schuman, Attorney Kevin Young and 7 residents.

The Public Hearing on proposed Local Law #3-2015 was called to order at 7:15 pm.  The notice calling for the hearing was read.  Attorney Kevin Young explained the proposed law that would rescind Local Law #3-2014 thereby insuring the qualified taxpayers of the Town would receive their rebates from New York State because the Town stayed within the tax cap during fiscal year 2015 and to override the tax levy limit for fiscal year 2016.  Rebate checks would be minimal and 2016 Tentative Budget figures are under the Tax Cap amount.  With no comments being heard from the public in favor of or against the proposed law the hearing closed at 7:19 pm.

The regular meeting was called to order at 7:30 pm.

The Minutes of the September meeting were approved on motion of Gene Cronk second by Edward Raeder.

Highway Supt. Stephen Schuman reported crews are cleaning ditches and repairing shoulders, getting dirt roads ready for winter, salt deliveries have begun, one truck is down for repairs, took refrigerators at the Transfer Station to Walton and stated there are a few trees that need to be taken down.  A recent Fire Inspection also suggested building a dike around used oil storage containers in case of leaks. The matter will be looked into.  It was also reported that the lifts need inspection and men must be trained.

Parks Clerk, Carolynn Faraci reported the last event has been held in the park so bathrooms have been winterized and building locked, bookings continue into 2016, the summer Youth Program is expected again for next year and the highway department plans to fix the park road shortly.

Mrs. Faraci also discussed the recent report by the State on fiscal stress in municipalities.  Stress levels are determined by a point system, a total of 29 for Towns, and the percentage of that total based on financial status.  25% of total points initiate the level of stress. Averages are at 12%, but Roxbury received a very good rating of 6% and is therefore not in financial stress.

Tire Day was held October 10th and brought in many tires.

Mike Jonker of LVDV Operations, Inc. reported the following:

*Grand Gorge Water- a leak was found at Park Lane Trailer Park and will be repaired.  A possible leak by Beauty Kreations was looked into by Rural Water but nothing was found.  There was no chlorine found in the water in the basement in the most recent testing and neighbors stated they frequently have water.  The Water Operator will keep an eye on the matter.

*Roxbury Water-the Town has been trying to obtain approval from NYS Dept. of Health (NYSDOH) to bring the springs into operation again after having been shut down due to being under the influence of surface water.  In July 2015 required testing for one year began. The process was discussed and NYSDOH will determine from reports if the springs can once again be used.

Use of them would lower pumping costs but could possibly also require additional chemicals.

*Denver Water-no problems but conditions of some water lines will be looked into due to age.

*Denver Sewer-problems have been encountered with the micro filters and have been repaired.  Concerns were raised and discussed pertaining to the age of the system and upgrades needed in the near future.  Attorney Young discussed a program that would pick up some costs but homeowners would also have to pay more.  Therefore, he suggests starting to think about the needed repairs now while the District shares costs with NYCDEP.  Kevin Young will also speak to DEP regarding capital replacement.

Jonker also stated LVDV Operations, Inc. will be closing their office on Main Street.  They plan to use the Roxbury Sewer pump station office for computer and internet connection.  Options were discussed and possibly the internet connection could be paid all or in part by DEP.

Building Inspector, William Walcutt had a written monthly report for the Town Board but also reported the Short Run Road matter has been cleaned up to his satisfaction and the Dugan Hill matter is still in poor condition.  Issues were also raised regarding 2nd story egress issues with the Merwin apartment house in Grand Gorge.  There are other apartment houses having the same conditions and it was determined that rope ladders from windows may be acceptable.

Discussion took place on the letter received from Patricia Davis requesting status of the Zoll property that was issued a Condemned Structure notice in 2013.  The building was recently auctioned and purchased by a bank. Building Inspector Walcutt stated he recently inspected the property and found the outside of the structure and property to now be in acceptable condition as the lawn has been mowed and the damage to the front porch has been cleaned up.

Discussion took place on the letter received by the Building Inspector from NYCDEP regarding proposed rehab to the Shandaken Tunnel Intake Chamber.  The Town Board would like to be kept informed of the work so the Building Inspector will request a copy of the plans per Supervisor Hynes’ request and it will be determined if a building permit is needed.

The Building Inspector also discussed the large amount of open building permits that have not been closed out.  He  requested Attorney Young to draft a letter to be sent to open permit holders.

The attorney will draft a letter.

Charles & Cherie Serrie expressed concerns with a neighbor’s outdoor woodstove that blows smoke into and against their home and stated they have reported the matter to NYSDEC as well.  The woodstove was installed by a previous owner in 2008. The owner of the woodstove was present and options were discussed on how to resolve the problem. Attorney Young will contact DEC and speak to an engineer about the matter and report back to the owner who was told that he could continue to use the woodstove.

It was stated the Assessor’s office has filed the paperwork with the State for reimbursement funds for completing the re-valuation.  It now appears the reimbursement may be less than the $5.00/parcel that had been anticipated.

No action was taken on the Police Policy.

On motion of Allen Hinkley second by Gene Cronk the Town Board approved the Town Clerk’s monthly report for September 2015 in the amount of $3,283.41 (Town Clerk $2,803.41 and Building Permits $480.00).

WHEREAS, in accordance with subdivision 5 of General Municipal Law §3-c of the State of New York which provides municipalities with the express authorization to override the tax levy limit established in General Municipal Law §3-c by passing a Local Law approved by a vote of at least sixty percent (60%) of the Town Board; and

WHEREAS, the Town Board adopted a resolution on September 14, 2015 scheduling a public hearing on the proposed Law for October 12, 2015; and

WHEREAS, the public hearing on the proposed Local Law was held on October 12, 2015 at the Town Hall; and

WHEREAS, the Town Board reviewed and considered all public comments received on the proposed Law; and

WHEREAS, the proposed Law was on file for inspection at the Clerk’s office prior the hearing and during the public review process; and

NOW THEREFORE, BE IT RESOLVED AS FOLLOWS BY THE TOWN BOARD OF ROXBURY, DELAWARE COUNTY, NEW YORK:

A Dog Control Officer inspection by the State has received a satisfactory rating.

Attorney Kevin Young concerns raised with the odors emanating from the Mountainside Creamery sewage plant and what is being done to control it.  Issues arise when removing the sludge and when the sludge is spread on fields.

It was stated the November regular meeting of the Town Board would be held Thursday November 5, 2015 at 7:30 pm or immediately following the Public Hearing, whichever is later.

In addition, the Commissioners will hold their regular October meeting on 10/20/15, immediately following the hearing, to act on the budget and to discuss and act on district business.

Roxbury Town Board Meeting Approved Minutes - September 14, 2015

APPROVED MINUTES

September 14, 2015

The regular meeting of the Town Board was held September 14, 2015 at 7:30 pm at the Town Hall.  Present were: Supervisor Thomas S. Hynes, Councilmen Gene Cronk, Edward Raeder, Allen Hinkley and Carol Murray, Hwy. Supt. Stephen Schuman, Attorney Kevin Young and 2 residents.

The Minutes of the August 10th meeting were approved on motion of Gene Cronk second by Allen Hinkley.

Hwy. Supt. Stephen Schuman stated stone & oil has been completed for the year on 16 miles of road, crews are doing repairs & widening the top of West Settlemernt Rd., working dirt roads for winter, ditching roads for 2016 stone & oil, the water filter system has been installed at the garage and he would like to include a new Ford 550 truck for the 2016 budget.

Councilwoman Murray questioned Johnson Hollow Rd. being in very bad need of repairs and sides eroding in spots. The matter was discussed.  The Highway Supt. stated crews have been placing more stone and filling  in those areas but to fix it right would cost $200,000 +/- and no organization wants to fund it at this time.

A written Assessor  report was distributed to the Town Board.  Assessor Clerk Stephanie Seminara stated she has not received many calls regarding the school tax bills incorporating the new re-val figures, Assessor Breglio is back to work,  they are waiting to hear on a SCAR decision and have two Article 7 assessment cases in October.

Parks Clerk, Carolynn Faraci reported the Labor Day event was a success adding that the same is planned for next year but will also hold a pancake breakfast, discussed work that has been completed in the park and  stated more bad trees are to be removed.

A possible leak was excavated on Cronk Lane, however no problem was found.  A representative from Rural Water will be here tomorrow to help locate the problem.

An estimate of work for repairs to the Transfer Station concrete was received from B&B Construction in the amount of $9,800.  Repairs will require the station to be closed for a few days.  The Highway Dept. is expected to complete the welding portion of the work.

RESOLUTION #69-APPROVE B&B CONSTRUCTION ESTIMATE ON TRANSFER STATION REPAIRS

On motion of Allen Hinkley second by Gene Cronk the following resolution was offered and adopted:

“RESOLVED, the Town Board accepts the proposal of B&B Construction for repairs to the Transfer Station in the amount of $9,800.00; and

BE IT FURTHER RESOLVED, per the proposal, the Town Board approves the cost of a pump truck if needed at a cost of $950.00 per use.”

Councilman Raeder reported on several broken/cracked windows at the Civic Center.  The matter will be looked into further.

A NYSEG energy audit was conducted on the Town Hall where lighting would be switched over to LED at a cost of $2,290.43.  Through the program, the Town’s share would be $890.11.

RESOLUTION #70-APPROVE NYSEG ENERGY PROGRAM

On motion of Carol Murray second by Edward Raeder the following resolution was offered and adopted:

“RESOLVED, the Town Board approves the changes to lighting at the Town Hall through the NYSEG Energy Efficiency Program at a cost of $890.11.”

A proposal was received from Lamont Engineers, PC for preparing the design, bid specs and bid materials in the amount of $10,000.  Discussion took place on using Good Neighbor funds for some costs to upgrade the generator at the highway garage.

RESOLUTION #71-ACCEPT LAMONT ENGINEERING PROPOSAL FOR GENERATOR BID

On motion of Allen Hinkley second by Gene Cronk the following resolution was offered and adopted:

“RESOLVED, the Town Board accepts the proposal of Lamont Engineer, PC to prepare the design, specifications and bid documents for upgrading the generator at the highway garage at a cost of $10,000; and

BE IT FURTHER RESOLVED, the Town Board authorizes the use of $25,000 of Good Neighbor Funds to pay for costs associated with the generator and the engineering of same provided said use is approved by NYC DEP.”

A letter was received from Diana Santos requesting late fees be waived on her Roxbury Water account that resulted from a late payment of $.44 charged to her account on 8/3/15.  The matter was discussed by the Town Board.

On motion of Gene Cronk second by Edward Raeder the Town Board agreed the $.44 late fee charged for the Roxbury Water District  account #186 of Diana Santos was not to be credited.

A letter was received from Jay and Deborah Gula requesting to hook up their house, located at 60090 State Hwy 30, Grand Gorge, to the Grand Gorge Water District.  A stub had been installed when the water line had been run from Roxbury Water.

RESOLUTION #72 – APPROVE GULA HOOKUP TO GRAND GORGE WATER

On motion of Edward Raeder second by Carol Murray the following resolution was offered and adopted:

“WHEREAS, the Town Board has received a letter from Jay & Deborah Gula requesting permission to connect their house, Tax Map #91.-1-56.7,  located at 60090 State Hwy 30,  to the Grand Gorge Water line; and

WHEREAS, the property is outside of the Grand Gorge Water District; and

WHEREAS, a stub was installed on the water main when the line was run from Roxbury Water to Grand Gorge Water;

NOW, THEREFORE BE IT RESOLVED, the Town Board authorizes Jay & Deborah Gula to connect their house, Tax Map #91.-1-56.7,  located at 60090 State Hwy 30, to the Grand Gorge Water line at their own expense, a meter would be supplied by the water district and provided they execute a water connection agreement; and

BE IT FURTHER RESOLVED, once the lateral line is connected, the property will be added to the Grand Gorge Water District on the tax roll.”

A letter was received from Highway Supt. Stephen Schuman stating that he is retiring from said position effective November 16, 2015.

An email was received from Fran DiGregorio on behalf of the owners of Stratton Falls Campsite, Anna & Stanislaw Duszak, questioning what could be done about the new owners of the Stratton Falls house property, which contains the falls, posting the property as No Trespassing.  The Town Board took no action on the matter because it is not Town business as it currently stands.

Budget Officer Carolynn Faraci discussed the Tax Freeze program which would allow for property owners to receive a small rebate check, much like the school tax rebate checks that were received.  The Nov. 2014 Local Law to override the tax levy limit would have to be rescinded and a tax plan would be required to be submitted to the State.

RESOLUTION #73 – RESOLUTION OF THE ROXBURY TOWN BOARD ACCEPTING PROPOSED LOCAL LAW TO RESCIND LOCAL LAW NO. 3 OF 2014 AND TO OVERRIDE THE TAX LEVY LIMIT FOR FISCAL YEAR 2016 AS ESTABLISHED IN GENERAL MUNICIPAL LAW §3-c AND SCHEDULING PUBLIC HEARING FOR SAME

On motion of Carol Murray second by Edward Raeder the following resolution was offered and adopted:

“WHEREAS, on June 24, 2011 the New York State Legislature enacted Chapter 97 of the NYS Laws of 2011, hereinafter referred to as the “General Municipal Law §3-c”;

WHEREAS, General Municipal Law §3-c expressly authorizes local governments to override the tax levy limit by the adoption of a local law approved by a vote of at least sixty percent (60%) of the total voting power of the governing body (in this case, the “Roxbury Town Board”) ;

WHEREAS, the Town’s Attorney has prepared a proposed Local Law to Rescind Local Law No. 3 of 2014 since the 2015 Budget was kept within the tax levy limit thereby insuring that the qualifying taxpayers of the Town of Roxbury receive their rebates from New York State and to Override the Tax Levy Limit for fiscal year 2016 as established in General Municipal Law §3-c; and

WHEREAS, the Town Board has reviewed and modified the proposed Local Law to Rescind Local Law No. 3 of 2014 and to Override the Tax Levy Limit for fiscal year 2016 as established in General Municipal law §3-c; and

NOW, THEREFORE, BE IT RESOLVED that the proposed law is ready for consideration by the Town Board; and

BE IT FURTHER RESOLVED that the Town Board shall will hold a public hearing for consideration of the Local Law to Rescind Local Law No. 3 of 2014 and to Override the Tax Levy Limit for fiscal year 2016 as established in General Municipal Law §3-c on October 12, 2015 at 7:15  pm at the Town Hall; and

BE IT FURTHER RESOLVED that the Town Clerk is hereby authorized and directed to publish notice of said hearing in the Catskill Mountain News, and to post copies of such notice in the manner provided by law.”

BE IT FURTHER RESOLVED, said bids must be received before 2:00 pm on October 9, 2015 at which time they will be opened.  Any award will be made at the October 12, 2015 Town Board meeting.”

Notice to Bidders

NOTICE TO BIDDERS

1.     Sealed bids will be received by the Town of Roxbury, hereinafter referred to as the “Owner,” until 3:00 pm, Thursday, October 8th, 2015, at the Town Clerk’s Office, 53690 State Highway 30, Main Street, Roxbury, NY 12474, at which time said bids will be publicly opened and read aloud for:

Contract No. 1 – DPW Garage Generator

Contract No. 1 shall include all tools, labor, material and equipment necessary to:

Provide a new 80 KW diesel generator and automatic transfer switch to serve the existing DPW Garage and an existing radio antenna on-site; remove existing generator that serves the radio antenna; and provide wiring from the new generator to existing automatic transfer switch that feeds the radio antenna. Work also includes related site work for the new generator. Under base bid, owner shall retain the removed generator for future salvage.

Deductive Alternate No. 1.1 – Contractor salvage of existing generator.

2.     All bids must be made on the blank form of proposal included in bidding documents.

3.     A bidder may withdraw any proposal submitted prior to the hour set for the closing of the bids provided the request is signed in a manner identical with the proposal being withdrawn.

4.     The Owner will be responsible for payment in accordance with the terms of the contract when the work is completed.

5.     The Owner is exempt from New York State sales taxes on material, supplies, and equipment to be permanently incorporated in the Work.  Tax Exemption No. 15-6001121.  Said taxes shall not be included in the Bid.

6.     A complete set of Bidding and Contract Documents may be obtained from Lamont Engineers upon payment of a $50.00 deposit.  Full deposit refund for the returned set will be made provided that the complete set of Bidding and Contract Documents (Project Manual) is returned to Lamont Engineers, postage paid and in good condition within 30 days after Bid Opening.  Any sets returned after the 30-day period are non-refundable. Additional sets of Bidding and Contract Documents may be obtained upon payment of a $25.00 deposit for each set.  Deposits for additional sets will be returned less the actual cost of reproduction if the complete sets are returned in good condition within the 30-day period. Requests for delivered sets of Bidding and Contract Documents will be honored overnight upon receipt of a non-refundable fee of $25.00 per set for handling and delivery.

7.     The Town Board of the Town of Roxbury reserves the right to waive any informalities or irregularities in the bids received and to reject any or all bids without explanation.

8.     The existing DPW Garage site and facilities (52508 State Highway 30, Roxbury) will be open for review by bidders on Tuesday, September 29th, 2015 from 10:00AM-12:00 Noon. If bidders are unable to make this time, they may try to schedule an appointment with the Highway Superintendent Stephen Schuman (607 326-4222).

At such time and place all persons interested in the subject matter thereof will be heard concerning the same.

Copies of the proposed law shall be available at the time of the hearing and shall be available at times prior to and after the hearing at the Town Clerk’s Office during normal business hours for the purpose of inspection or procurement by interested persons.

The proposed Local Law to Rescind Local Law No. 3 of 2014 relating to Fiscal Year 2015 and to Override the Tax Levy Limit for Fiscal Year 2016 as established in General Municipal Law §3-c establishes the Roxbury Town Board’s intent to override the limit on the amount of real property taxes that may be levied by the Town of Roxbury during fiscal year 2016.
