Roxbury Town Planning Board Meeting
Present: Rob Cole, Phil Zorda, Dave Cowan, Jill Ribich, secretary and alternate member, Molly Oliver of Delaware Co Planning Dept. Kevin Young, Attorney for the Town of Roxbury.
Absent: Joe Farleigh, Melanie Lee, Jean Stone, Dave Zambri
Also present Rob Allison representing The Roxbury (Motel), Greg Henderson & Joseph Masa of the Roxbury Motel. Eleven members of the community attended.
Acting Vice-Chairman Dave Cowan called the public hearing to order at 7:30 PM.
The public hearing announcement was published in the paper and the proper mailings were completed.
Greg Henderson, partner in the development, Roxbury at Stratton Falls, stated the main reason for the public meeting was to “get ducks in a row” to secure financing for the project. He gave a brief history of the property at Stratton Falls where the Roxbury of Stratton Falls is to be developed. Economic benefits to the community: they maintain 22 people on a permanent payroll at this time. Every dollar spent in this community has a direct effect on the economy of the community. Also indirect benefit of the Roxbury and guests spend money in the community, and the induced effect of their employee’s spending money here and elsewhere.
Mr. Henderson presented photos of the property, past and present, and their plans for the renovation of the house. The general exterior design of the house will not change. There will be a mudroom added to the front entrance. The second addition is in the rear of the house which is mostly bringing back an extension of the original house, adding 15 additional feet. This will be a dining/meeting area for the guests. The themes of each of the seven rooms will reflect the history of the house. Five additional accommodation dwellings will be added; three will be duplexes, two will be single dwellings. They will be placed along the site of the original road through the property. This will equal a total of 15 guest units at the Stratton Falls site. There will also be a manager’s apartment. The plans include 40 parking spaces. The stone bridge will be reinforced, but unchanged in structure. The current entrance/driveway will be moved according to the requirements of the Delaware County Dept. of Public Works. There will be a swimming pool with a cabana and a spa added to the property and hiking trails created that will take people to the area of the falls where a small observation deck will be built at the top of the falls. A second deck will be built looking back at the falls. The trail will not be lighted so as not to encourage people to hike that area at night. There will be some low lighting of the falls themselves. They might build a pedestrian bridge making the trail into a loop.
Rob Allison, project manager and surveyor, talked about the site development. The site plan was designed to preserve wildlife and trees with the least amount of disruption of the existing property.
Review letter from the county to shift the proposed new entrance farther from the structure of the bridge in order to accommodate access to the bridge. The proposed driveway will be moved 14 feet farther to the NE of the existing entrance. Retaining walls will be built if needed, the banks graded. Storm water system consists of a series of ponds and underground tanks. 1.6 acres will be developed.
They are constantly presenting information as requested to the different regulatory agencies to stay current with regulations and requirements.
1. Signage will be at the entrance monuments and up lighted. This will be the only signage on County Rd. 41. Other signage is on the property and presented in the info to the planning board.
2. Lighting: the lighting plans have been revised several times. The lighting will be minimal. There will be 54 fixtures of reduced lumens: many small sconces, walkway lights, up lighting tucked into the property so as not to disturb guests or neighbors.

4. Entrance from the road will be moved according to requirements of the review letter from the county.
5. A second well will be added. The well water will be treated in a small treatment (chlorine) facility in the basement of the house pending approval off DOH.
Marshall Rudd, resident of Cold Spring Road, asked if the guiderail along Cold Spring Rd. at the site of the falls will be moved so that people cannot park along the road to walk down the falls. There is an existing “pull off” along the road. Mr. Rudd feels that cars in this area can create a hazard to cars driving on Cold Spring Road as there is a blind curve just above this point. Mr. Henderson stated that is in the highway right-of-way, and that any changes there will need to come from the Town. This “pull off” is along a town road and not a part of the Roxbury at Stratton Falls property.
Allen Hinkley, Town of Roxbury Fire Chief asked is there will there be any public access to the falls? Mr. Henderson stated that they want the public to be able to enjoy the falls “within reason”. He will ask his attorney about this subject. Mr. Hinkley expressed his support of the project.
Brian Muldar, resident of Cold Spring Road, also expressed support of the project.
Mr. Rich Kreig, who lives directly above the Stratton Falls property was concerned about the lighting, but is pleased to hear the plans of minimal lighting. Mr. Henderson explained that most lighting will be green and not obtrusive.
Acting vice-chairman, Dave Cowan asked if there were further comments from the public and proposed to close the public hearing at 8:30, seconded by Phil Zorda.

Rob Allison distributed more information for the folders of the planning board. Mr. Henderson and Mr. Masa also remained.
They have submitted information to SHPO. They cannot get DEC approval without SHPO approval.
There was a discussion between a representative of SHPO and Mr. Henderson about if he is interested in listing the house on the National Historic Register. The mudroom addition would be the only deterrent to this designation. This could have an impact on funding, permits, and construction plans as they are presented today.
There was discussion of adding a footbridge over the stream at a later time. DEP commented that they should use indigenous plants and avoid introducing any invasive species. Mr. Henderson also commented on the possibility of future signage along the walking path naming the plants.
They asked what further information is required by the planning board to approve the project by April 15th?
Mr. Young and Ms. Oliver felt that performance spec plan should suffice. The plan should be very close to what will actually be built via the site plan and leaving room for minor adjustments required by government agencies.
Minutes of February meeting were amended to show that Jean Stone was absent from that meeting, and that the date of the March meeting should read March 18th rather than March 15th. Motion to approve the amended minutes by Phil Zorda and seconded by Rob Cole. 9:35 PM.

Acting Chairman Dave Cowan called the meeting to order at 7:30.

It was suggested by Phil Zorda that Melanie Lee should be asked to officially step down from the planning board due to lack of attendance.
Rob Allison re: The Roxbury Motel. One well has been drilled on the property known as “The Roxbury at Stratton Falls” producing the minimum flow of 8 gal. per minute. A second well will be drilled at the upper end of the property. Retaining walls and parking lots were pointed out on the site map. They are waiting on the county for approvals on some of these projects.
Mr. Allison presented drawings of the house showing two additions: a mud room on the front and a breakfast room on the back of the building with balcony/patio above with stairs leading down. The drawing also depicted the return of a pergola on the roof as was the case in the original building.
Mr. Allison requested that there be a public meeting in March to inform adjoining properties and the public to present the project as proposed and to address any concerns regarding the proposed construction project. Mr. Allison also said that his client would waive the 60 day waiting period for a public meeting. Notice of the public hearing must go out 15 days prior to the scheduled meeting on March 18th. It was suggested that they bring presentations for the:

3. Septic
4. Entrance from the road
A motion was made by Phil Zorda to have the public hearing regarding the site plan for the Roxbury at Stratton Falls as requested above. Second by Rob Cole. All in favor.
It was requested that Mr. Allison include the SEQRA and site plan application be added to the presentation books of the Planning Board members.

Town Board Meeting Approved Minutes - March 2, 2015

March 2, 2015
A Public Hearing and regular monthly meeting of the Town Board was held March 2, 2015 at 7:15 pm at the Town Hall. Present were: Supervisor Thomas S. Hynes, Councilmen Gene Cronk, Edward Raeder, Allen Hinkley and Carol Murray, Highway Supt. Stephen Schuman, Assessor Robert Breglio and 3 residents. Absent: Attorney Kevin Young.
The Public Hearing on proposed Local Law #1 of the year 2015 entitled “Town of Roxbury Board of Assessment Review Law” was called to order at 7:15 pm. The notice calling for the hearing was read. The proposed law would allow for the Board of Assessment review to expand from three to five members. With no comments being heard in favor of or against the proposed law the hearing closed at 7:19 pm.
The regular meeting of the Town Board was called to order at 7:30 pm.
Minutes of the February 9, 2015 meeting were discussed with Councilman Cronk requesting the minutes be amended to reflect that he did not offer to donate a vacuum cleaner but rather stated he had a vacuum cleaner that he would sell to the Town.
On motion of Carol Murray second by Allen Hinkley the Minutes of the February 9, 2015 meeting were approved after amending them to reflect “The Town Clerk requested approval to purchase a new vacuum cleaner for the Town Hall as the current one is in bad shape. Councilman Cronk stated he had a vacuum cleaner that he would sell to the Town.”

Kyle Faraci and Shannon Sprague were recognized for attendance at the Town Board meeting as part of their Government Class at Roxbury Central School.
Highway Supt. Stephen Schuman requested approval to purchase two new Henderson plow wings for $7,730, requested purchasing a 2014 Boom Mower for $134,037 that had been included in the 2015 Budget, will contact someone to repair the overhead door problems, has placed his last order for salt before a price increase, has received a new compressor and requested the Town Board accept the two lowest bidders for all material hauling bids except he requested accepted all three bids for Stone & Item 4 from Schoharie.
The Town Board complimented the Highway Dept. on excellent work keeping the roads clear this winter.
Sealed bids for Highway material hauling were advertised and opened on March 2, 2015 at 2:15 pm at the Town Hall. A total of four (4) bids were received and were as follows on a per ton basis:

On motion of Allen Hinkley second by Carol Murray the following resolution was offered and adopted:

WHEREAS, the Boom Mower would be purchased under an NJPA Contract;

Assessor Robert Breglio gave a written monthly report to the Town Board and specific items stating the re-val impact notice will be mailed this week, discussed the info contained on the notices, stated owners can make an appointment with him to discuss their assessment and if still not happy can go to grievance, tax exemptions have been received, he now has complete access to RPS, reported there was a very poor attendance at the two public info meetings held, requested advertising for additional Board of Assessment Review members if Local Law is adopted, and is still waiting to receive information from Attorney Beebe regarding NYCDEP values.
Parks/RHPC Clerk/Bookkeeper Carolynn Faraci stated the Roxbury Historic Preservation Commission (RHPC) meeting scheduled for March 21, 2015 has been canceled due to having no business to discuss and stated, beginning April 18, 2015 the RHPC requests meeting quarterly on the third Saturday at 10:00 am at the Town Hall, stated the Annual Financial Report for 2014 has been filed with the State and a copy is filed at the Town Clerk’s office and reported reservations for park building rentals continue to come in daily with 26 events already scheduled.
Supervisor Hynes stated there have been several frozen water service lines in the Roxbury and Grand Gorge water districts due to cold weather. Titan and The Water Guy have had a 50% effective rate in clearing the lines. Some owners have had to run hoses from neighbors.
A thank you was received from the Roxbury Sr. Club for the $500.00 approved in the 2015 Town Budget.
No action was taken on renewing the current Police Policy as it is still under review by Attorney Young.

RESOLUTION #33- In the Matter of the Adoption of Local Law No. 1 of 2015 entitled “Town of Roxbury Board of Assessment Review Law”
On motion of Edward Raeder second by Gene Cronk the following resolution was offered and adopted:
“WHEREAS, pursuant to Real Property Tax Law (“RPTL”) Section 523, each local government is required to have a board of assessment review that shall consist of not less than three nor more than five members appointed by the Town Board of the Town of Roxbury;
WHEREAS, to date, the Town of Roxbury’s Board of Assessment Review has consisted of three appointed members; and
WHEREAS, RPTL expressly authorizes the Town Board of the Town of Roxbury to increase the number of members of the Board of Assessment Review to a total of five members by passing a local law;
WHEREAS, the proposed Law was presented to the Town Board at least 11 days prior to the Town Board meeting on February 9, 2015 and
WHEREAS, the Town Board adopted a resolution on February 9, 2015 scheduling a public hearing on the proposed Law for March 2, 2015; and
WHEREAS, the public hearing on the proposed Local Law was held on March 2, 2015 at the Town Hall; and
WHEREAS, the Town Board reviewed and considered all public comments received on the proposed Law; and
WHEREAS, the proposed Law was on file for inspection at the Clerk’s office prior the hearing and during the public review process; and
NOW THEREFORE, BE IT RESOLVED AS FOLLOWS BY THE TOWN BOARD OF
ROXBURY, DELAWARE COUNTY, NEW YORK:
The Town of Roxbury Local Law entitled Board of Assessment Review Law, being Local Law No. 1 of 2015, is hereby adopted and the Town Clerk is hereby directed to file said Local Law with the Office of the Secretary of State in accordance with State Law.

RESOLUTION #34-HISTORIC PRESERVATION COMMISSION MEETING CHANGE
On motion of Carol Murray second by Allen Hinkley the following resolution was offered and adopted:
“WHEREAS, on January 2, 2015 the Town Board approved the Roxbury Historic Preservation Commission (RHPC) to hold their regular monthly meetings on the third Saturdays of the month at 10:00 am at the Town Hall, and
WHEREAS, the RHPC has requested to hold their meetings quarterly,
NOW, THEREFORE BE IT RESOLVED, effective April 18, 2015, the Roxbury Historic Preservation Commission will meet quarterly on the third Saturday of the month at 10:00 am at the Town Hall.”

RESOLUTION #35-HIGHWAY EQUIPMENT RESERVE FUND
On motion of Edward Raeder second by Gene Cronk the following resolution was offered and adopted:
“WHEREAS, the Highway fund had unexpended funds at the end of 2014; and
WHEREAS, the Town has a reserve fund for highway equipment purchases,
NOW, THEREFORE BE IT RESOLVED the Town Board approves the transfer of $50,000 from Highway savings to the Highway Equipment Reserve fund.”

As advertised, the next meeting of the Town Board scheduled for April 13, 2015 will be held at the Grand Gorge Civic Center at 7:30 pm.
The Town CPA’s will begin the audit for the year 2014 in May.
The Town Clerk questioned if the bill just received from Gene Cronk for the used vacuum cleaner was to be added to the abstract. The Town Clerk and Deputy Town Clerk expressed concerns with operation of the unit but Councilman Cronk assured that he would fix the problem.
On motion of Edward Raeder second by Carol Murray the bill from Gene Cronk in the amount of $250 was added to the abstract as General Fund #116 and all bills were audited and ordered paid in the following amounts:

RESOLUTION #36 – RESOLUTION TO GO INTO EXECUTIVE SESSION TO DISCUSS A PERSONNEL ISSUE
On motion of Allen Hinkley second by Carol Murray the following resolution was offered and adopted:
“RESOLVED, the Town Board agrees to enter into Executive Session at 8:20 pm to discuss a personnel issue. Present were: Supervisor Thomas S. Hynes, Councilmen Allen Hinkley, Edward Raeder, Gene Cronk and Carol Murray.”

What to Do When You Disagree With Your New Preliminary Assessment
When a property owner disagrees with their new preliminary assessed value as shown in the Impact Notice, remedies are available to the homeowner, starting with an informal meeting with the assessor.
At an informal meeting, the assessor can explain to the property owner the basis upon which the new assessment is based. A property owner may submit evidence of valuation of their property at this assessment disclosure meeting, but it is not required. A property owner may simply attend, review the assessment information and leave to decide if further assessment review is warranted on their part.

Grievance Day is the one day each year that the Board of Assessment Review meets to hear formal complaints regarding property assessments.
The Board has the authority to change an assessment if they determine a change is warranted.
Grievance forms must be filed on or before Grievance Day and are available at the Roxbury Assessor’s office or through the links below.

The idea of ‘Large Works’ first came about through brain-storming led by Elaine Grandy and Ros Welchman during a Gallery Committee Meeting. Grandy and Welchman are currently active on the board of directors for the Roxbury Arts Group and are both established and respected artists themselves. “We were excited about the possibilities ‘Large Works’ offered artists, allowing them to ‘go big’. We had no idea what to expect and were overwhelmed by the artists’ responses to this challenge”, said Jenny Rosenzweig, Executive Director for the Roxbury Arts Group. Rosenzweig added, “Every time a large piece came in for the installation, the excitement level rose. Each piece is magnificent and together they make an awe-inspiring show.”
The art pieces represented in ‘Large Works’ utilize many mediums and genres by means of paintings, murals, fabric sculptures and more. Local and regional artists represented in this grand-scaled show include: Nancy Barton, Beth Caspar, Adam Cohen, Louis D’Amico, Ann Dubois, Fred Duignan, Tabitha Gilmore-Barnes, Robert Gould, Samuel Guy, Kate Hamilton, Laura King, Helene Manzo, Dana Matthews, Gary Mayer, Nat Thomas, Gerda vanLeeuwen, Corneel Verlaan, Beatrice Wolert, and Peter Yamaoka. ‘Large Works’ will be on exhibit from March 7 through April 18, 2015.

Vice Chairman Cowan called the meeting to order at 7:30 PM.
Minutes of the December meeting were reviewed and approved. Zorda, Stone – Passed.
Phil Zorda moved, seconded by Jean Stone to approve the minutes of the December 17, 2014 meeting. Motion approved unanimously.
Rob Allyson updated the Board on the progress of design and planning for The Roxbury at Stratton Falls project. Rob presented and reviewed the letters from the NYS DEC, NYDEP, and NYS Dept. of Health agreeing that the Roxbury Planning Board would assume Lead Agency status for the project. At the present time the well is being dug and has not yet yielded the required flow rate. Septic and grading planning is continuing. An architect has been chosen and they are beginning design. Rob expects to have further updates at the February meeting. It is possible that a public hearing could be held in March. The owners’ goal is to have preliminary Site Plan approval at the April 15 Board meeting. Molly Oliver indicated that there was an initial letter from the DEC concerning the project and that Rob is to forward a copy of the letter to the Board. She also indicated that minor changes to the SEQR document may be needed after design is finalized.
Phil Zorda moved, seconded by Rob Cole to approve the Roxbury Planning Board as Lead Agency for the project. Motion approved unanimously.
Emily Gray asked the Board about the requirements to sell an approximately 2 acre piece of her 42 acre property to an adjoining neighbor. This piece of her property contains a large storage building that she has no use for. She was told that it appears that it would be a Boundary Line Adjustment. She would be required to have the piece of property surveyed and present a BLA application and a survey map to the Board.
Phil Zorda moved, seconded by Dave Cowan to adjourn the meeting at 8:15. Motion approved unanimously.

Dare to Share – Roxbury Dream Campaign will continue this year with dreamers and doers, sharing new ideas and projects, and engaging the community in an inspiring dialogue.
Dare to Share – Roxbury Dream Campaign features people with great ideas and dreams of becoming entrepreneurs as well as established business leaders in an attempt to inspire others to do the same. On February 24 Roxbury and Margaretville business owners who participated in the Valentine’s Day shared promotion initiative will reveal the response to this campaign. Peg Ellsworth, Executive Director of MARK Project, will talk about the upcoming MARK Main Street Boot Camp. Tabitha Gilmore-Barnes will discuss a survey from Cornell Cooperative Extension to gauge interest in a direct farmer-to-consumer selling program. And, GRBA’s Branding Committee will discuss the next steps in Roxbury’s branding campaign. There will be time for community announcements as well.
This event is free and open to the public – you do not have to be a member to attend. There will be free refreshments and a cash bar. A suggested donation of $10 will help GRBA advance its mission to continue to foster economic development opportunities in Roxbury.

Assessor Robert Breglio distributed a written monthly report to the Town Board. He gave an update on the re-val explaining the sample data sheet that includes comparables, discussed the problems he is still encountering with the County in gaining access to the system to input data, stated the impact statements will be mailed in March and reminded the Board that he will be holding two public info meetings on the re-val on Feb. 14th at 1:00 pm at the Grand Gorge Civic Center and 3:00 pm at the Town Hall. Attorney Kevin Young discussed the information the Town is waiting to receive from Attorney Beebe pertaining to NYCDEP assessments.
Discussion took place on additional Board of Assessment Review (BAR) members needed this year due to the re-val. The duties of the BAR were discussed as well as the grievance process.
RESOLUTION #20 – RESOLUTION OF THE ROXBURY TOWN BOARD ACCEPTING PROPOSED LOCAL LAW TO INCREASE MEMBERSHIP OF THE BOARD OF ASSESSMENT REVIEW AND SCHEDULING PUBLIC HEARING FOR SAME
On motion of Gene Cronk second by Carol Murray the following resolution was offered and adopted:
WHEREAS, pursuant to Real Property Tax Law (“RPTL”) Section 523, each local government is required to have a board of assessment review that shall consist of not less than three nor more than five members appointed by the Town Board of the Town of Roxbury;
WHEREAS, to date, the Town of Roxbury’s Board of Assessment Review has consisted of three appointed members; and
WHEREAS, RPTL expressly authorizes the Town Board of the Town of Roxbury to increase the number of members of the Board of Assessment Review to a total of five members by passing a local law;
WHEREAS, the Town’s Attorney has prepared a proposed Local Law to increase the number of members of the Board of Assessment Review from three to five pursuant to RPTL Section 523; and
WHEREAS, the Town Board has reviewed and modified the proposed Local Law to increase the number of Board of Assessment Review members from three to five;; and
NOW, THEREFORE, BE IT RESOLVED that the proposed law is ready for consideration by the Town Board; and
BE IT FURTHER RESOLVED, that the Town Board shall will hold a public hearing for consideration of the Local Law to increase the number of members of the Board of Assessment Review on March 2, 2015 at 7:15 pm at the Town Hall; and
BE IT FURTHER RESOLVED, that the Town Clerk is hereby authorized and directed to publish notice of said hearing in the Catskill Mountain News, and to post copies of such notice in the manner provided by law.

Highway Supt. Stephen Schuman stated the roller repairs have almost been completed, work continues on the grader, his laptop has been repaired but is still encountering problems with files, requested new plow wings for two Oshkosh trucks at approximately $6,000 each, requested a new air compressor for the garage at approximately $600 and stated he expects a salt delivery soon.
Attorney Young stated he has received a check for $9,000 as a settlement amount in the truck lawsuit and will turn it over to the Town.
Parks Clerk, Carolynn Faraci stated the Historic Preservation Commission (HPC) has requested the Town Board appoint Jenny Rosenzweig to the Commission to fill the vacancy. The HPC also requests they hold quarterly meetings instead of monthly meetings but will have a special meeting in between in the need arises.
RESOLUTION #21-APPOINT ROSENZWEIG TO HISTORIC PRESERVATION COMMISSION
On motion of Allen Hinkley second by Gene Cronk the following resolution was offered and adopted:
“WHEREAS, a vacancy exists on the Roxbury Historic Preservation Commission due to the resignation of Martin Lerner,

Discussion took place on repealing Local Law #3-2014 overriding the tax cap limit. Attorney Young was directed to look into the matter.
Supv. Hynes distributed a report of 2015 Delaware County Tax Levy comparisons reflecting information on each of the 19 Towns. Roxbury was the 3rd lowest percent change at .52%. Percentages ranged between -.24% and 6.98%.
Discussion took place on appointing alternate members to the Planning Board having adopted Local Law #4-2014.
RESOLUTION #22-APPOINT RIBICH AS PLANNING BOARD ALTERNATE
On motion of Carol Murray second by Edward Raeder the following resolution was offered and adopted:
“WHEREAS, on November 6, 2014 the Town Board adopted Local Law #4-2014 for the Appointment of Alternate Members to the Planning Board,
NOW, THEREFORE BE IT RESOLVED, the Town Board appoints Jill Ribich as an alternate member of the Planning Board effective immediately with said term to expire 12/31/19.”

David Martin of the Grand Gorge Community Action Group (GGCAG) requested use of the extra classroom at the Civic Center for supply storage as the room they’re currently using is full. The matter was discussed by the Town Board with Supv. Hynes and Councilman Edward Raeder expressing concerns with additional use because the room is already being used for storage by other groups and is also used frequently by the justice court as a conference room for attorney’s and clients during court sessions. Councilman Cronk saw no problem with GGCAG using the room. The Town Board will look into the matter further.
Supv. Hynes discussed the Roxbury springs matter where the Town awaits a response from NYS Dept. of Health on the Town’s request to once again allow use of the springs for Roxbury and Grand Gorge water districts. Lamont Engineers, Cowan Excavating and previous water operator Robert Townsend have assisted in the efforts.
Supv. Hynes has received notice from NYS Dept. of Health stating the sample monitoring reports on the water districts have been approved.
Discussion took place on concerns of the buildings at the site of the old Reed’s Hotel property on Main St. Roxbury. A written report from Lamont Engineers regarding demolition issues and estimated costs was distributed to the Town Board. A factor in cost will be whether there is asbestos and lead paint. Attorney Young discussed the demolition process and the Board will look into costs if demo is completed by County forces. Attorney Young will look into the process to obtain access to the buildings from the owners.
No action was taken on renewing the Police Policy. It is still being reviewed by the Town Attorney.

Attorney Young discussed the funds from Invenergy, LLC that the Town of Roxbury has been holding in escrow since the onset of the windtower application per the terms of the local law to pay costs associated with the review process. “WHEREAS, Invenergy, LLC submitted an application for wind turbines to the Town of Roxbury Planning Board in July 2007; and
WHEREAS, Invenergy, LLC deposited funds into an escrow account to be held by the Town of Roxbury to pay for costs during the review process; and
WHEREAS, no costs have been incurred since November 2010;
NOW, THEREFORE BE IT RESOLVED, the Town Board authorizes the fund balance in the Windtower escrow account, in the amount of $5,648.49, which includes bank interest, be returned to Invenergy, LLC.”

RESOLUTION #28-TRANSFER STATION PART-TIME HELP
On motion of Edward Raeder second by Gene Cronk the following resolution was offered and adopted:
“RESOLVED, the Town Board approved the hiring of Larry Truesdell on an as- needed basis for additional part-time help at the Transfer Station; and
BE IT FURTHER RESOLVED, rate of pay shall be determined by who he is working for either as Manager $17.19/hr or Laborer $11.57/hr.”

The Town Clerk requested approval to purchase a new vacuum cleaner for the Town Hall as the current one is in bad shape. Councilman Cronk stated he had a vacuum cleaner that he would sell to the Town. (amended per March 2, 2015 meeting)
The Grand Gorge Community Action Group would like to help beautify Grand Gorge by hanging flower baskets from the light poles. The project would have to be sponsored by the Town of Roxbury for permits from NYSEG and NYS Dept. of Transportation. No Town Board member stated any objection to sponsoring the project.
Discussion took place on the costs for repairs to the Constable vehicle. Councilwoman Carol Murray and Councilmen Edward Raeder and Gene Cronk objected to the Town Board not being made aware of the work to be done and the estimate of repair costs prior to repairs being completed. However, the Councilmen did agree to pay the vendor. A note was also received from Sanford Auto stating issues with the airbags. The Town Board agreed the vehicle must be taken to a Chevrolet dealer to ascertain the problem and estimate for repairs.

NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN that a public hearing will be held before the Town Board for the Town of Roxbury at the Roxbury Town Hall on the 2nd day of March 2015, at 7:15 p.m., regarding the adoption of a Local Law to increase the membership of the Roxbury Board of Assessment Review from three members to five members. This law is being proposed to comply with Section 523 of the Real Property Tax Law which expressly authorizes the Town Board to adopt a local law to change the membership of the Board of Assessment Review to no more than five members. At such time and place all persons interested in the subject matter thereof will be heard concerning the same.
Copies of the proposed law shall be available at the time of the hearing and shall be available at times prior to and after the hearing at the Town Clerk’s Office during normal business hours for the purpose of inspection or procurement by interested persons.

Please take notice that the Town Board, Town of Roxbury, is seeking sealed bids for hauling materials from Schoharie, Middleburgh, Lexington, Davenport, Ashland and Oneonta, on a per ton basis to the NYS Rt. 30 storage area and/or the Cty. Hwy. 41 storage area located in Roxbury.
Bids must include a Certificate of Liability Insurance in the amount of $1,000,000 and a Certificate of Non-Collusion. Sealed bids shall be marked “MATERIAL HAULING”.
